ARTICLE 1 - IDENTITY OF THE ENTITIES

The COBAGAGE platform is operated by the following entities (hereinafter “Cobagage”):- Cobagage Network Inc, a company incorporated under U.S. law (United States)- Cobagage Network France, a company incorporated under French law- Cobagage Network Côte d’Ivoire, a company incorporated under Ivorian law

Depending on the User’s country of residence, the legally competent entity may vary. The main operating entity of the platform is Cobagage Network Inc (USA).

ARTICLE 2 - PURPOSE

These General Terms and Conditions of Sale (GTCS) govern:- the sale of new or second-hand items between Users,- Shopping Travel services,- donations of items,- payments, fees/commissions and tips, carried out via the COBAGAGE mobile application and website.

Cobagage acts solely as a technical intermediary for connecting Users and is never the seller, the buyer, the carrier, or the owner of the items.

ARTICLE 3 - DEFINITIONS

• Buyer / Shopper: User who orders an item or a service.

• Traveler / Seller: User who transports, purchases, or sells an item.

• Shopping Travel: service by which a Traveler purchases an item on behalf of a Buyer.

• Transaction: operation concluded between a Buyer and a Traveler.

• Delivery Code: unique code generated by the Application to validate delivery/hand-over.

• No-Show: absence or unreachability of the Buyer at the agreed meeting time.

ARTICLE 4 - AUTHORIZED PRODUCTS AND SERVICES

The following may be offered on Cobagage:- personal items (new or second-hand),- items purchased as part of Shopping Travel,- free donations of items.

The following are strictly prohibited:- illegal, dangerous, or regulated items,- counterfeit goods,- products prohibited by local or international laws.

The User is solely responsible for the legality of the items offered.

ARTICLE 5 - ROLE OF COBAGAGE

Cobagage:- connects Buyers and Travelers,- provides the technical infrastructure,- secures payments,- provides internal messaging,- applies dispute and No-Show procedures.

Cobagage does not guarantee the quality, conformity, or effective delivery of items.

ARTICLE 6 - ORDER PROCESS

1. The Buyer selects an item or creates a Shopping Travel request

2. The Traveler accepts or declines the request

3. Payment is made via the Application

4. Delivery is carried out according to the agreed terms

5. The hand-over is validated using the Delivery Code

Without a valid Delivery Code, the transaction is not deemed completed.

ARTICLE 7 - PRICES AND FEES

The Buyer pays:- the estimated or fixed price of the item,- applicable taxes,- Cobagage service fees,- an optional tip freely set for the Traveler (optional).

Donations of items are free of charge.

Prices are freely set by Users.

ARTICLE 8 - PAYMENT

Payments are:- prepaid,- secured,- processed via third-party providers (e.g., Stripe, Mobile Money).

Cobagage does not store full payment card/bank details.

Cobagage charges a commission on each transaction, displayed in the Application.

ARTICLE 9 - DELIVERY

Delivery may be:- in-person hand-over,- or carried out according to the terms agreed between Users.

Cobagage is not responsible for delays, loss, or damage.

ARTICLE 10 - DELIVERY CONFIRMATION (CODE)

Delivery is deemed completed only after validation via the Delivery Code generated by the Application.

Without validation:- payment may remain on hold,- the transaction may be disputed.

ARTICLE 11 - NO-SHOW PROCEDURE

In case of absence or unreachability of the Buyer:

1. The Traveler initiates the No-Show procedure

2. At least two contact attempts via Cobagage messaging are required

3. Cobagage may contact the Buyer by email or phone

If no response is received within 24 hours, the transaction is marked “Buyer unreachable”.

Cobagage may then:- pay fees and tips to the Traveler,- apply the applicable allocation/redistribution rules.

After 7 days without response, the item may be considered abandoned, subject to applicable laws.

ARTICLE 12 - CANCELLATION AND REFUND

• Before acceptance: full refund

• After acceptance: service fees are non-refundable

• In case of dispute: refund after verification

ARTICLE 13 - LIABILITY

Cobagage:- is not a party to the contract of sale,- assumes no liability regarding the items,- disclaims any liability in the event of disputes between Users.

Cobagage’s liability is strictly limited to its role as a technical intermediary.

ARTICLE 14 - SUSPENSION AND TERMINATION

Any fraudulent, abusive, illegal, or repeated conduct (No-Show, abusive disputes) may lead to:- restriction,- suspension,- permanent deletion of the account.

ARTICLE 15 - GOVERNING LAW

• EU Users: French law

• USA Users: Delaware law

• Côte d’Ivoire Users: Ivorian law

ARTICLE 16 - ACCEPTANCE

Use of the platform constitutes full and unconditional acceptance of these GTCS

ARTICLE 1 - IDENTITY OF THE ENTITIES

These General Terms and Conditions of Purchase (hereinafter “GTCP”) are issued by:- Cobagage Network Inc, a company incorporated under U.S. law (United States)- Cobagage Network France, a company incorporated under French law- Cobagage Network Côte d’Ivoire, a company incorporated under Ivorian law

The main operating entity of the platform is Cobagage Network Inc (USA).

ARTICLE 2 - PURPOSE

These GTCP define the rights and obligations of Buyers / Shoppers using the COBAGAGE platform for:- purchasing new or second-hand items,- using the Shopping Travel service,- receiving items delivered by Travelers,- validating deliveries via a code.

These GTCP complement the General Terms and Conditions of Sale (GTCS) and the General Terms of Use (GTU).

ARTICLE 3 - DEFINITIONS

• Buyer / Shopper: User who orders an item or a service.

• Traveler: User responsible for purchasing, transporting, or handing over an item.

• Item: tangible good that is the subject of the transaction.

• Delivery Code: unique code generated by the Application to validate the hand-over.

• No-Show: absence or unreachability of the Buyer at the meeting time.

ARTICLE 4 - ACCESS CONDITIONS FOR THE BUYER

To use Cobagage purchasing services, the Buyer must:- be of legal age and have legal capacity,- create an account with accurate information,- have a valid payment method,- accept the GTCP, GTCS, GTU and related policies.

Any breach may result in account restrictions.

ARTICLE 5 - PURCHASE PROCESS

The purchase process is as follows:

1. The Buyer selects an item or creates a Shopping Travel request

2. The Traveler accepts or declines the request

3. The Buyer makes advance payment

4. The Traveler performs the mission

5. Delivery is carried out

6. The Buyer validates the hand-over using the Delivery Code

Without code validation, the transaction is not considered completed.

ARTICLE 6 - PAYMENT AND FINANCIAL COMMITMENT

The Buyer agrees to pay:- the price of the item,- applicable taxes,- Cobagage service fees,- any optional tip for the Traveler.

Payments are:- prepaid,- secured,- processed by third-party providers (e.g., Stripe, Mobile Money).

Cobagage does not store full payment card/bank details.

ARTICLE 7 - BUYER OBLIGATIONS

The Buyer agrees to:- be present at the agreed place and time,- remain reachable via the Application,- check Cobagage messaging,- provide the Delivery Code at hand-over,- respect the Traveler.

Any breach may trigger the No-Show procedure.

ARTICLE 8 - DELIVERY CONFIRMATION

Delivery is deemed completed only when:- the Item is handed over, and- the Delivery Code is entered and validated in the Application.

Without validation:

- payment may remain on hold,

- the transaction may be subject to a dispute.

ARTICLE 9 - BUYER ABSENCE / NO-SHOW

In case of absence or unreachability of the Buyer:

1. The Traveler initiates the No-Show procedure

2. A minimum of two (2) contact attempts is required

3. Cobagage may contact the Buyer via messaging, email, or phone

Without response within 24 hours, the transaction is marked “Buyer unreachable”.

Cobagage may then:- pay fees and tips to the Traveler,- apply the applicable redistribution rules.

After 7 days without response, the Item may be considered abandoned, subject to applicable laws.

ARTICLE 10 - CANCELLATION AND REFUND

• Before acceptance by the Traveler: full refund

• After acceptance: service fees are non-refundable

• In case of dispute: possible refund after review

Refunds are issued to the original payment method.

ARTICLE 11 - DISPUTES

In case of a dispute with a Traveler, the Buyer may:- contact Cobagage support,- provide the necessary evidence,- cooperate with the resolution procedure.

Cobagage acts as a technical mediator, without being a party to the sale.

ARTICLE 12 - LIABILITY

The Buyer acknowledges that:- Cobagage is neither seller nor carrier,- Cobagage is not responsible for the quality of Items,- transactions are concluded between Users.

Cobagage’s liability is strictly limited to its intermediary role.

ARTICLE 13 - SANCTIONS

Any abusive, fraudulent, or repeated conduct (No-Show, abusive disputes, breach of rules) may lead to:- warning,

- temporary suspension,- permanent deletion of the account.

ARTICLE 14 - GOVERNING LAW

Depending on the Buyer’s country:- France / EU: French law- United States: Delaware law- Côte d’Ivoire: Ivorian law

ARTICLE 15 - ACCEPTANCE

Use of purchasing services constitutes full and unconditional acceptance of these GTCP
